ACB ARRESTS ASSISTANT GENERAL MANAGER (TECHNICAL) FOR MALAWI HOUSING CORPORATION

On 24th March, 2011, the Anti-Corruption Bureau received a complaint alleging that Malawi Housing Corporation is selling institutional houses to its staff members and tenants at prices which are far below the houses’ book values.

The Anti-Corruption Bureau instituted investigations which established that there was failure to declare interest by the Assistant General Manager (Technical) Mr. Floyd Mondiwa, in the transaction. Mr. Mondiwa’ wife purchased one of the houses.

On 24th October, 2011, the Anti-Corruption Bureau arrested Mr. Floyd Mondiwa. He was taken to Blantyre Magistrate’s Court. He will be charged with one  count of non disclosure of interest by public officers contrary to Section 25 D(1) of the Corrupt Practices Act and one count of misuse of public office contrary to Section 25B (1) of the Corrupt Practices Act.

He was granted bail on the following conditions:

  • To surrender travel documents to the Anti-Corruption Bureau
  • Not to interfere with any state witnesses
  • To report to the Anti-Corruption Bureau offices in Lilongwe once every fortnight on Mondays
  • To deposit with the Court the sum of MK40,000.00 cash
  • To provide two sufficient sureties approved by the Court in the sum  of K100,000.00 each not cash
  • Not to leave Lilongwe without the approval of the Director of Anti-Corruption Bureau

On 5th October, 2011, the Anti-Corruption Bureau received a complaint alleging that there were corrupt activities at Accountant General’s Office involving loss of public resources in excess of MK400 Million.

The Anti-Corruption Bureau instituted investigations which confirmed the allegation.

On 19th and 20th October, 2011, the Anti-Corruption Bureau arrested Richard Kapinga, Senior Accounts Clerk at Accountant General’s Office, Peter Kambona of Malswitch and Hanter Kabvina, IT Manager at Accountant General’s office respectively. They were taken to Lilongwe Magistrate’s Court.

They will be charged with possession of unexplained property contrary to Section 32(2) (c) as read with Section 35 of the Corrupt Practices Act and corrupt practices by or with public officers contrary to Section 24 (2) of the Corrupt Practices Act.

They were released on bail on the following conditions:

Richard Kapinga and Hanter Kabvina

  • Bonded at  K50,000.00 each  cash
  • Produced one reliable surety each bonded at K500,000.00 not cash
  • To report to the Anti-Corruption Bureau in Lilongwe once every fortnight
  • To surrendered travel documents to the court
  • Not to leave Lilongwe without the authority of the Director of the Anti-Corruption Bureau

Peter Kambona

  • Bonded at  K70,000.00  cash
  • Produced one reliable surety bonded at K50,000.00 cash
  • To report to the Anti-Corruption Bureau in Lilongwe once every fortnight
  • To surrendered travel documents to the court

They will appear in court on a date to be set by the court for commencement of trial.

On 2nd July, 2009, the Anti-Corruption Bureau received a complaint alleging that police officer Patrick Chipote, of Mponela Police Station solicited K20, 000.00 but received K10, 000.00 in order to soften bail reporting times for Raphael Kazembe who had been released on police bail.

The Anti-Corruption Bureau instituted investigations which confirmed the allegation. The investigation also found that Patrick Chipote committed the offence together with Wonderful Chipo.

On 5th October, 2011, the Anti-Corruption Bureau arrested Police officers Patrick Chipote and Wonderful Chipo. They were taken to Mponela Magistrate’s Court.

They were charged with two counts of corrupt practices by public officer contrary to Section 24 (1) of the Corrupt Practices Act.

They were released on bail on the following conditions:

  • Bonded at  K50,000.00 each not  cash
  • Produced one reliable witness each bonded at K5,000.00 cash
  • To report to the Anti-Corruption Bureau in Lilongwe once every fortnight
  • To surrender travel documents to the Bureau

They will appear in court on 2nd November, 2011 for commencement of trial.

On 21st October, 2011, the Anti-Corruption Bureau arrested Mr. Golden Grant Matiya. He was taken to Blantyre Magistrate’s Court. He will be charged with two counts of non disclosure of interest by public officers contrary to Section 25 D(1) of the Corrupt Practices Act and two counts of misuse of public office contrary to Section 25B (1) of the Corrupt Practices Act.

He was granted bail on the following conditions:

  On 8th September, 2007, the Anti-Corruption Bureau received a complaint alleging that Peter Kapeta whose real name is Frank Mwalamwaza, used his relative’s certificate to get enrolled at Malamulo School of Health Science at Makwasa.

 The Anti-Corruption Bureau instituted investigations which confirmed the allegation.

 On 4th October, 2011, the Anti-Corruption Bureau arrested Frank Mwalamwaza. He was taken to Mulanje Magistrate’s Court. He was charged with two counts of personating contrary to Section 389 and 391 0f the Penal Code. He pleaded guilty to the charges. The court convicted him on his own plea of guilty.

 On 10th October, 2011, Mulanje Magistrate’s Court sentenced him to nine months and three months imprisonment with hard labour respectively. The sentences were suspended to three years.

On 9th January, 2007, the Anti-Corruption Bureau received a complaint alleging that sergeant Albert Kamalo, of Mwanza Police Station (now working as a security officer at Malawi Postal Corporation) solicited and received K5, 000.00 from Mr. Harry Banda in order to release him on police bail.

 The Anti-Corruption Bureau instituted investigations which confirmed the allegation.

 On 28th September, 2011, the Anti-Corruption Bureau arrested Police officer Albert Kamalo. He was taken to Mwanza Magistrate’s Court. He was charged with two counts of corrupt practices by public contrary to Section 24 (1) of the Corrupt Practices Act and one count of abuse of public office contrary to Section 25B (1)  of the Corrupt Practices Act.

 He was released on bail on the following conditions:

 Deposited with the court a bond of K2,000.00 cash

  • Produced two reliable sureties
  • To report to the Anti-Corruption Bureau every Friday
  • Surrendered travel documents to the court

He will appear in court on 27th October, 2011 for commencement of trial.

 On 13th August, 2009, the Anti-Corruption Bureau received a complaint alleging that Police Officer Kenneth Kapichi of Mzuzu Police Station solicited and received K500.00 and K200.00 from Marko Phiri and Samson Gama in order for him to release Frank Phiri on police bail. Frank Phiri had been arrested for being in possession of property (cell phone) suspected to have been stolen. The allegation further stated that police officer Kapichi also solicited K3, 000.00 from Frank Phiri in order for him to release the cell phone which he had recovered as an exhibit.

 The Anti-Corruption Bureau investigated the matter and confirmed the allegation.

 Police Officer Kenneth Kapichi was taken to Mzuzu Magistrate’s Court.  He was charged with two counts of corrupt practices by a public officer contrary to Section 24(1) of the Corrupt Practices Act, one count of misuse of public office contrary to Section 25B (1) of the Corrupt Practices and one count of common assault contrary to Section 253 of the Penal Code.

 On 15th September, 2011, Mzuzu Magistrate’s found police officer Kenneth Kapichi guilty of the four charges.

 On 20th September, 2011, Mzuzu Magistrate’s Court sentenced Kapichi to 24 and 18 months imprisonment with hard labour on the first two and third counts respectively. The sentence has been suspended to 18 months. He was fined K45, 000.00 for common assault. K20, 000.00 will be paid to government while K25, 000.00 will be paid to the victim. He has since paid the fine.
