ACB ARRESTS POLICE OFFICERS IN MCHINJI AND KASUNGU

ARREST OF POLICE OFFICERS IN MCHINJI
On 10th August, 2009 the Anti-Corruption Bureau received a complaint alleging that messrs Chisuse and Nthengu and four other police officers of Mchinji Police Station received K8, 000.00 from a person whose fertilizer was confiscated in order to release the fertilizer.
The Anti-Corruption Bureau instituted investigations into the matter which confirmed the allegation.
On 15th June, 2011, the Anti-Corruption Bureau arrested Julius Nthengu and Austin Chisuse at Kazyozyo Police Unit. They were taken to Mchinji Magistrate’s Court where they were granted bail on the following conditions:
- Bonded at K5, 000.00 each not cash
- Produced one surety each bonded at K2, 000.00 cash each
- To report to Mchinji Magistrate’s Court once every fortnight on Fridays
They will be charged with two counts of corrupt practices by public officer contrary to Section 24 (1) of the Corrupt Practices Act and two counts of misuse of public office contrary to Section 25 B (1) of the Corrupt Practices Act.
They will be taken to Court on a date to be set by the court.
ARREST OF POLICE OFFICERS IN KASUNGU
On 13th August, 2007 the Anti-Corruption Bureau received a complaint alleging that a police officer at Kasungu Police Station demanded and received some money from suspects in order for him to release the suspects on bail.
The Anti-Corruption Bureau instituted investigations into the matter which confirmed that police officer Titus Jeremane solicited and received K3,000.00 in order to release two suspects on police bail.
On 15th June, 2011, the Anti-Corruption Bureau arrested Titus Jeremane. He was taken to Kasungu Magistrate’s court where he was granted bail on the following conditions:
- Bonded at K15, 000.00 not cash
- Produced one surety of K10, 000.00 not cash
- To report to Kasungu Magistrate’s Court once every fortnight on Mondays
- To report to court on the date of trial before commencement of trial
He will be charged with four counts of corrupt practices by public officer contrary to Section 24 (1) of the Corrupt Practices Act and one count of misuse of public office contrary to Section 25 (B) (1) of the Corrupt Practices Act.
He will be taken to court on a date to be set by the court.

ANTI-CORRUPTION BUREAU ARRESTS T/A MPHONDE IN NKHOTAKOTA

On 2nd December 2008 and 22nd June, 2009, The Anti-Corruption Bureau received complaints alleging that T/A Mphonde of Nkhotakota demands money from those who want to be installed as Village Headmen and Group Village Headmen.
The Anti-Corruption Bureau investigated the allegations. They were confirmed to be true.
On 7th June 2011, the Anti-Corruption Bureau arrested Malijani Kajombo (TA Mphonde).
He was taken to Nkhotakota Magistrate’s Court. He was charged with three counts of corrupt practices by public officer contrary to Section 24 (1) of the Corrupt Practices Act. He pleaded not guilty to all the charges.
He was granted bail on the following conditions:
- Own Surety bonded at K10,000 (not cash)
- To report for bail at Nkhotakota Magistrate Court on Mondays once every fortnight
He will appear in court on 25th July, 2011 for trial.

FORMER DIRECTOR OF FINANCE OF KARONGA DISTRICT COUNCIL ARRESTED BY ACB

In 2008, the Anti-Corruption Bureau received a complaint alleging that the Director of Finance for Karonga District Council together with some Members of Parliament in Karonga misappropriated materials for projects. The funds for the projects were under the Local Development Fund.
The Bureau instituted investigations which confirmed the allegation that Mr. Andrew Mustaf Jaffari (Director of Finance) prepared payment without following procedures. Mr. Benard Mwakaileke (former Member of Parliament for Karonga North Constituency) misappropriated the materials for the projects.
On 24th May, 2011, the Anti-Corruption Bureau arrested Mr. Andrew Mustaf Jaffari. He was taken to Salima Magistrate’s Court. He was charged with abuse of office contrary to Section 25 B (1) of the Corrupt Practices Act.
He was released on bail on the following conditions:
- Produced K20,000.00 cash
- Produced two reliable sureties bonded at K10,000.00 cash each
- Report to Karonga Police Unit once every week
- Surrender travel documents to court
He will be taken to court in Karonga on 22nd to 24th June, 2011 for commencement of trial.
On 26th May, 2011, the Anti-Corruption Bureau arrested Mr. Benard Mwakaileke, former Member of Parliament for Karonga North Constituency. He converted building materials worth K949, 210.00 for projects in his constituency to personal use.
He was taken to court where he was charged with two counts of misuse of public Office contrary to Section 25B (1) of the Corrupt Practices Act. He was released on bail of the following conditions.
- Deposited with the court K20,000.00 cash
- Produced two reliable sureties bonded at K15,000.00 cash each
- Report to Karonga Police Unit once every week on Mondays
- Surrender travel documents to the Anti-Corruption Bureau
He will appear in court from 22nd to 24th June, 2011 in Karonga.

COURT CONVICTS PETER KUNYADA

The Anti-Corruption Bureau received a complaint alleging that Mr. Peter Blessings Kunyada who was then working as Assistant Human Resource Management Officer at Capital Hill solicited K12, 000.00 but received K2, 000.00 from a retired Civil Servant in order for him to process her terminal benefits.
The Anti-Corruption Bureau instituted investigations into the matter which confirmed the allegation.
On 18th August, 2010, the Anti-Corruption Bureau arrested Peter Blessings Kunyada who was at that time, working as a Bursar at Balaka Secondary School. He was taken to Balaka Magistrate’s court. He was charged with three counts of corrupt practices contrary to Section 24 (1) of the Corrupt Practices Act and one count of abuse of public office contrary to Section 25 B (1) of the Corrupt Practices Act.
Trial took place at Lilongwe Magistrate’s Court.
On 26th May, 2011, Lilongwe Magistrate’s Court found Peter Blessings Kunyada guilty on one count of abuse of public office contrary to Section 25B(1) of the Corrupt Practices Act. He was sentenced to nine months imprisonment with hard labour. The court acquitted him on the first three counts

COURT FINDS ROAD TRAFFIC DIRECTORATE OFFICERS WITH A CASE TO ANSWER
In 2009 the Anti-Corruption Bureau recorded a complaint (through a newspaper article) alleging corrupt practices in the issuance of driver’s licences at the Road Traffic Directorate in Lilongwe
The Anti-Corruption Bureau instituted investigations into the matter which confirmed the allegation
On 28th December, 2009 the Anti-Corruption Bureau arrested Masida Kumwenda (Data Entry Clerk), Mr. Enoch Mtimuni (Motor Examiner) and Mr. Rodgers Moleni Chief Motor Examiner at the Road Traffic Directorate in Lilongwe.
Masida Kumwenda was charged with two counts of abuse of office contrary to Section 25B(1) of the Corrupt Practices Act and one count of neglect of official duty contrary to Section 121 of the Penal Code.
Mr. Enoch Mtimuni was charged with one count of abuse of office contrary to Section 25B(1) of the Corrupt Practices Act, one count of uttering a false document contrary to Section 360 of the penal code and one count of neglect of official duty contrary to Section 121 of the Penal Code.
Rodgers Moleni was charged with one count of neglect of official duty contrary to Section 121 of the Penal Code.
On Thursday 12th May 2011, the Senior Resident Magistrate Court found the three with a case to answer in respect of all the three counts they are charged with.
The case continues in court on 4th July 2011 for defence.
