ACB ARRESTS PATRICIA MWAFULIRWA IN KARONGA

In 2008, the Anti-Corruption Bureau received a complaint alleging that Mrs. Patricia Papano Mwafulirwa former Member of Parliament for Karonga South Constituency misappropriated funds for school projects in her constituency. The funds for the projects were under the Rural Development Fund.
The Bureau instituted investigations which confirmed the allegation.
On 19th May, 2011, the Anti-Corruption Bureau arrested Mrs. Patricia Mwafulirwa. She was taken to Karonga Magistrate’s Court. She was charged with abuse of office contrary to Section 25 B (1) of the Corrupt Practices Act.
She was released on bail on the following conditions:
- Produced K20,000.00 cash
- Produced two reliable sureties bonded at K20,000.00 cash each
- She should seek permission from the Officer-in –Charge of Karonga Police Station before leaving Karonga
- Report to Karonga Police Unit once every fortnight
She will be taken to court at on 22nd June, 2011 for commencement of trial.

COURT FINDS ROAD TRAFFIC DIRECTORATE OFFICER WITH A CASE TO ANSWER
In 2009 the Anti-Corruption Bureau recorded a complaint (through a newspaper article) alleging corrupt practices in the issuance of driver’s licences at the Road Traffic Directorate in Lilongwe
The Anti-Corruption Bureau instituted investigations into the matter which confirmed the allegation.
On 28th December, 2009 the Anti-Corruption Bureau arrested Mr. Gibson Ngwira, a Senior Traffic Officer at the Road Traffic Directorate in Lilongwe.
Mr. Ngwira was charged with three offences under the Corrupt Practices Act, the Penal Code and the Road Traffic Act namely Misuse of Public Office contrary to section 25B (1) of the Corrupt Practices Act, Neglect of Official Duty contrary to section 121 of the Penal Code and Negligence in the Issuance of a Driver’s License contrary to section 24(6) of the Corrupt Practices Act.
On Tuesday 03rd May 2011, the Senior Resident Magistrate Court found Gibson Ngwira with a case to answer in respect of all the three counts.
The case goes to court on 25th May 2011 for defence.

ANTI- CORRUPTION BUREAU ARRESTS MORE FORMER MINISTRY OF AGRICULTURE STAFF IN LILONGWE
In 2008, the Anti-Corruption Bureau received a complaint alleging that Ministry of Agriculture officials rewarded each other undeservedly in subsistence allowances. The allegation further stated that the corrupt practice had cost Government over K40 million.
The Anti-Corruption Bureau instituted investigations into the matter which confirmed the allegation.
The Bureau executed warrants of arrests on the following people who were at that time working with Ministry of Agriculture:
On Wednesday 20th April 2011, the Anti-Corruption Bureau arrested Mr. Innocent Thindwa, Professional Officer and charged him with 1 count of theft by a person employed in the Public Service, contrary to section 278 as read with section 283 (1) of the Penal Code. He failed to account for MK522, 000.00. He was taken to Lilongwe Magistrate’s Court. He was granted bail on the following conditions;
- Paid to the court MK20,000 cash
- Produced two sureties bonded at MK10, 000 not cash.
- He should report to Anti- Corruption Bureau every fortnight on Thursdays
- He should surrender all his travel documents to the court
- He should seek permission from the ACB when going out of Lilongwe
On Wednesday 20th April 2011, the Bureau arrested Mr. Gracewell Kumwembe, Professional Officer and charged him with 1 count of theft by a person employed in the Public Service, contrary to section 278 as read with section 283 (1) of the Penal Code. He failed to account for MK924, 000.00.
He was taken to Lilongwe Magistrate’s Court. He was granted bail on the following conditions;
- Paid to the court MK20,000 cash
- Produced two sureties bonded at MK10, 000 not cash.
- He should report to Anti- Corruption Bureau once every fortnight on Thursdays
- He should surrender all his travel documents to the court
- He should seek permission from the ACB when going out of Lilongwe
On 20th April 2011, the Bureau arrested Mrs. Pamela Munthali, Controller of Accounting Services and charged her with 11 counts of Misuse of Public Office contrary to section 25B (1) of the Corrupt Practices Act, 1 count of theft by a person employed in the Public Service, contrary to section 278 as read with section 283 (1) of the Penal Code. She failed to account for MK5, 292,000.00, She was taken to Lilongwe Magistrate’s Court. She was released on bail on the following conditions;
- She paid to the court MK50,000 cash
- Produced one surety bonded at MK20, 000 cash.
- She should report to Anti- Corruption Bureau every Thursday
- She should surrender all her travel documents to the court
- She should seek permission from the ACB when going out of Lilongwe
The case goes to court for trial on 01st and 02nd June 2011.

COURT CONVICTS KOMANI NYASULU
On 30th May, 2008, the Anti-Corruption Bureau arrested Komani Nyasulu a clearing clerk for Trade & Freight Connections in Lilongwe. It is alleged that on 30th December, 2007, Komani Nyasulu corruptly received K200, 000.00 from Vincent Murekezi a Rwandani busineman in order to facilitate evasion of duty of about K1, 600,000.00.
Komani Nyasulu was taken to Lilongwe Magistrate’s Court where he was charged with corrupt practices by a private person contrary to Section 26(1) of the Corrupt Practices Act.
On 29th April, 2011, Lilongwe Magistrate’s Court found Komani Nyasulu guilty and convicted him. He will be sentenced on 3rd May, 2011. He has been remanded at Maula Prison awaiting the sentence.

COURT CONVICTS CHILOMONI POLICE OFFICER
In 2009, the Anti-Corruption Bureau received a complaint alleging that Police Officer Makuwira of Chilomoni Police Post corruptly solicited an advantage in form of K1, 000.00 from a suspect. It was further alleged that the suspect would be released on police bail if he gave the money to Makuwira.
The Anti-Corruption Bureau investigated the matter and confirmed the allegation.
On 8th December, 2010, the Anti-Corruption Bureau arrested Makuwira. He was taken to Blantyre Magistrates Court. He was charged with two counts of corrupt practices by a public officer and one count of misuse of public office contrary to Section 24 (1) and 25B (1) of the Corrupt Practices Act respectively.
On 15th April, 2011, Blantyre Magistrate’s Court found Makuwira guilty of the three charges. On Wednesday, 20th April, 2011 Blantyre Magistrate’s Court sentenced Mc Donwell Makuwira to two years’ imprisonment with hard labour.
