ANTI- CORRUPTION BUREAU ARRESTS ANOTHER ELECTORAL COMMISSION MEMBER STAFF
The Anti-Corruption Bureau received a complaint alleging that MK 1.4 billion was misappropriated at the Electoral Commission.
On 7th December, 2010 the Anti-Corruption Bureau instituted investigations into the matter.
On 19 April, 2011, the Anti-Corruption Bureau arrested Hussein Batson (Excutive Officer) for possession of unexplained property in form of cash in his bank account.
He was taken to Lilongwe Magistrate’s Court where he was granted bail on the following conditions:
- Deposited K45,000.00 cash with the court
- Produced one reliable sureties each bonded at K100,000.00 not cash
- Surrendered travel documents to the court
- Ordered to report to the ACB once every fortnight on Tuesdays
- Not to leave Lilongwe without the authority of the Director of Anti-Corruption Bureau
- Not to enter Malawi Electoral Commission without the authority of Malawi Electoral Commission
He will be charged with possession of unexplained property contrary to Section 32 of the Corrupt Practices Act.
He will appear in court on a date to be set by the court.

ANTI- CORRUPTION BUREAU ARRESTS MINISTRY OF AGRICULTURE STAFF IN SALIMA
The Anti-Corruption Bureau received a complaint alleging that some ministry of Agriculture staff in Salima registered non existent villages during the 2007/ 2008 Farm Input Subsidy Progamme Registration.
The Anti-Corruption Bureau instituted investigations into the matter which confirmed the allegation.
On 30th March, 2011, the Anti-Corruption Bureau arrested William Kanyambwala and Rodgers Nkhoma.
They were taken to Salima Magistrate’s Court where they were charged with abuse of office contrary to Section 25B (1) and (2). They pleaded not guilty to the charges.
They were released on bail on the following conditions:
- Deposited K10,000.00 cash each with the court
- Produced one reliable surety each bonded at K50,000.00 each not cash
- Ordered to report at the nearest Police Unit once every fortnight on Wednesdays.
They will appear in court on 5th May, 2011 for trial.
In a related Development, the Anti-Corruption Bureau has arrested Leo Muhariwa an employee at the Malawi Electoral Commission in relation to the misappropriation of MK1.4 billion. He was taken to Lilongwe Magistrate’s Court where he was released on bail on the following conditions:
- Deposited K30,000.00 cash with the court
- Produced two reliable sureties each bonded at K10,000.00 not cash
- Surrendered travel documents
- Ordered to report to the ACB once every fortnight
- Not to leave Blantyre without the approval of the Director of Anti-Corruption Bureau
- Not to interfere with the state witnesses
He will be charged with possession of unexplained property contrary to Section 32 of the Corrupt Practices Act.
He will appear in court on a date to be set by the court.

On 28th and 29th March, 2011, the Anti-Corruption Bureau arrested Nodi Mwale, Annie Roseline Nathaya and Leonard Robin Paligolo for possession of unexplained property in form of cash in their bank accounts.
The two were taken to Blantyre Magistrate’s Court where they were released on bail on the following conditions:
- Deposited K30,000.00 cash with the court
- Produced two reliable sureties bonded at K10,000.00 each not cash
- Surrendered travel documents
- Ordered to report to the ACB once every fortnight
They will be charged with possession of unexplained property contrary to Section 32 of the Corrupt Practices Act.
Leonard Paligolo has been taken to Blantyre Magistrate’s Court for bail application.
They will appear in court on a date to be set by the court.

ACB ARRESTS TRADITIONAL AUTHORITY MSAMALA AND HIS COUNSELLOR
The Anti-Corruption Bureau received a complaint alleging that Mr. Adaki Besitoni (T/A Msamala) solicited K12,000.00 but received K6,000.00 as an advantage in order to rule a chieftaincy dispute in favour of acting village headman Chimpikizo. The allegation further alleged that the T/A solicited and received a goat and K4,000.00 through Mr. Laudoni Edward Salimu (T/A’s Counsellor), from Margaret Sopela in order to reinstate her as Village Headman Thamanda.
The Anti-Corruption Bureau conducted investigations into the matter which confirmed the allegation.
On 24th March, 2011, the Anti-Corruption Bureau arrested T/A Msamala and Mr. Laudon Edward Salimu. They were taken to Balaka Magistrate’s Court where T/A Msamala was charged with two counts of corrupt practices by a public officer contrary to Section 24 (1) of the Corrupt Practices Act. Laudon Salimu was charged with one count of aiding and abating a corrupt practice contrary to Section 25 (2) of the Corrupt Practices Act.
They were released on bail on the following conditions:
- Bonded at a non cash bond of K10,000.00 each as surety
- Produced one surety each bonded at K10,000.00 each not cash
The accused pleaded not guilty to the charges. The case goes to court on 25th May, 2011 for trial.

ACB ARRESTS SENIOR ACCOUNTS ASSISTANT AT NSANJE DISTRICT FORESTRY OFFICE
The Anti-Corruption Bureau received an allegation that Mr. Fideson Salijeni, Senior Accounts Assistant at Nsanje District Forestry Office paid himself allowances for a workshop he did not attend and presented a fake receipt for a venue where the workshop did not take place. The allegation further stated that that Mr. Salijeni paid workshop participants allowance for five days when they attended the workshop for only three days.
On 23rd February, 2011 the Anti-Corruption Bureau arrested Fideson Salijeni. He was taken to Nsanje Magistrate’s Court where he was charged with one count of misuse of public office contrary to Section 25B of the Corrupt Practices Act and one count of mismanagement of public funds contrary to Section 88 (1) of the Public Finance Act. He pleaded not guilty to both charges.
He was released on bail on the following conditions:
Deposited with the court K5,000.00 cash
- Produced one surety of K5,000.00 not cash
- He was also ordered to surrender his travel documents
He appeared in court on 18th March, 2011, for commencement of trial.
ACB ARRESTS COURT MARSHALS IN PHALOMBE
The Anti-Corruption Bureau received an allegation that Faison Damson and Alson George Mzengeza, Court Marshals at Phalombe Magistrate’s Court solicited K25, 000.00 from a litigant in order for them to assist him appeal against a court decision in a matrimonial case. The Bureau investigated the matter and confirmed the allegation.
On 14 March, 2011 the Anti-Corruption Bureau arrested Faison Damson and Alson George Mzengeza. They were taken to Phalombe Magistrate’s Court where they were charged with one count of abuse of office contrary to Section 25B (1) of the Corrupt Practices Act. They pleaded not guilty to the charges.
They were released on bail on the following conditions:
Non cash bond of K10,000.00 each
- Produced two sureties each bonded at K10,000.00 not cash
- Report to the nearest Police Unit once every fortnight on Mondays
They will be taken to court on 10th May, 2011 for commencement of trial.
COURT CONVICTS ELECTORAL COMMISSION EMPLOYEE FOR NON COMPLIANCE WITH A NOTICE
On 22nd December, 2010, the Anti-Corruption Bureau served Leonard Paligolo an employee of Malawi Electoral Commissin, a Notice to furnish the Director of Anti-Corruption Bureau within seven days, a Sworn Statement in writing enumerating all his property. He did not comply.
Following his failure to comply with the notice, the Anti-Corruption Bureau arrested Leonard Paligolo on 18th January, 2011. He was taken to Blantyre Magistrates Court where he was charged with one count of non compliance with Bureau’s Orders, Notices and Directions contrary to Section 49A of the Corrupt Practices Act.
On 9th March, 2011, Blantyre Magistrate’s Court found Leonard Paligolo guilty of the offence of non compliance with Bureau’s Orders, Notices and Directions contrary to Section 49A of the Corrupt Practices Act. He was fined K15, 000.00 cash or in default serve 3 months in prison. He has paid the fine.
The Court has also ordered Leonard Paligolo to furnish the Director of the Anti-Corruption Bureau with the Sworn Statement within seven days. He has complied with the order.
ACB ARRESTS TRADITIONAL AUTHORITY KALOLO IN LILONGWE
The Anti-Corruption Bureau received an allegation that Mr. Gilford Dangalasi Mpinganjira (T/A Kalolo) solicited and received K45, 000.00 in order to elevate Mr. Jekeseni Kum’buka from GVH Chibungo to Senior GVH. The Bureau investigated the allegation and further established that T/A Kalolo also received K11, 000.00 in order to install Esnart Petulo as GVH Msangwe.
On 21st March, 2011, the Anti-Corruption Bureau arrested Gilford Dangalasi Mpinganjira and took him to Lilongwe Magistrate’s Court. He was charged with two counts corrupt practices by public officer contrary to Section 24(1) of the Corrupt Practices Act and two count of abuse of public office contrary to Section 25B of the Corrupt Practices Act. He pleaded not guilty to both charges.
He was released on bail on the following conditions:
Deposited with the court K10,000.00 cash
- Produced one surety of K20,000.00 not cash
- Report to Namitete Police Unit once a on Tuesdays
He will appear in court on 23rd May, 2011, for commencement of trial.
